1. The 20th Anniversary Sweepstakes (the “Sweepstakes”) is sponsored by BCBGMAXAZRIAGROUP, Inc. (“BCBGMAXAZRIA”).
2.The Sweepstakes begins on October 19, 2009, and ends November 1, 2009, at 11:59 P.M. PST.
3. The Sweepstakes is open to legal residents of the US, excluding residents of Rhode Island, Puerto Rico and Canada, excluding residents of Quebec, who are 18 years of age or older as of October 19, 2009. Employees, agents and consultants, including their immediate family members and members of their household, of BCBGMAXAZRIA and its affiliates, partners, subsidiaries, distributors, franchisees and agents, including any advertising agencies and consultants, are not eligible to participate.
4. There are three ways to enter the Sweepstakes: (1) Online: Go to bcbgmaxazriagroup.com and click the "Sweepstakes" link in the header to be linked to the Official Entry Form. Complete all of the questions and provide your name, address, mobile number and email address (if you have one) and send your entry by clicking the "Submit" link. All online entries must be submitted by November 1, 2009, 11:59 P.M. PST. All US Mail entries must be postmarked by November 1, 2009, and received by November 7, 2009. (3) In Stores: Complete and submit an entry form at your local BCBGMAXAZRIA retail boutique October 19, 2009 through November 1, 2009. Submit your completed Sweepstakes entry ballot to any sales associate at a participating BCBGMAXAZRIA retail boutique no later than store closing on November 1, 2009. Entries submitted to non-BCBGMAXAZRIAGROUP, Inc. employees will not be entered into the drawing. All BCBGMAXAZRIA retail boutique entries must be received during store operation hours. Only one entry per person is allowed regardless of the method of entry.
5. One (1) grand prize will be awarded consisting of a $2,000 gift certificate for use in any BCBGMAXAZRIA retail boutique in the US toward the purchase of any BCBGMAXAZRIA merchandise, and a professional hair and makeup makeover. Certain restrictions may apply. Gift certificate may be used at any BCBGMAXAZRIA retail boutique located within the US, excluding retail boutiques located in Thousand Oaks, CA, and Sioux Falls, D. If a BCBGMAXAZRIA retail boutique is not located within a reasonable distance from the winner’s residence, arrangements will be made for the winner to order products via bcbg.com. Winner will receive store credit for any portion of the gift certificate not used; winner will not receive cash back, BCBGMAXAZRIA reserves the right to substitute a prize of equal or greater value at its sole discretion. The prize cannot be redeemed for cash and may not be substituted or transferred by the winner.
6. The odds of winning depend upon the number of eligible entries received.
7. BCBGMAXAZRIA is not responsible for telecommunications, network, electronic, technical or computer failures of any kind or for lost, stolen, misdirected, mutilated, late, incomplete or illegible entry forms or postage due. Void in Rhode Island, the Province of Quebec and outside of the United States (other than Canada). Entries that are generated by a script, macro or other automated means and/or otherwise not in compliance with these rules will be disqualified. BCBGMAXAZRIA shall have the absolute right to determine if an entry form is in compliance with these rules.
8. By entering the Sweepstakes, each participant warrants that he or she has read and agrees to abide by all Sweepstakes Official Rules, and that he or she is not prohibited from participating in the Sweepstakes. Each participant agrees to release, discharge, indemnify and hold harmless BCBGMAXAZRIA and its affiliates, partners, subsidiaries, distributors, franchisees, employees, officers, directors, agents, representatives and advertising and promotion agencies from any liability arising from or related to the Sweepstakes, including, without limitation, personal injury, death, property damage and claims based on publicity rights, defamation or invasion of privacy.
9. The winner will be determined by random drawing from all eligible entries on or around November 7, 2009. The drawing will be conducted by an independent representative selected by BCBGMAXAZRIA at the time of the drawing. All decisions of the representative are final and binding. Potential winners residing in Canada (excluding Quebec) will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by either telephone or email. If the skill-testing question is answered incorrectly, as determined by BCBGMAXAZRIA in its sole discretion, potential winners will be disqualified and, at our discretion, an alternate winner shall be chosen from among all remaining eligible entries.
10. In the event that the first entry form selected is discovered to be invalid for any reason whatsoever, or if the person who submitted the first entry form does not contact BCBGMAXAZRIA within the time frame specified below, another winner will be selected, subject to the same rules and conditions set forth herein.
11. The winner will be notified by email and/or telephone, and will be given instructions on how to claim the prize. BCBGMAXAZRIA is not responsible for lost, stolen, late or misdirected mail. If unable to make contact with the winner, or if the winner fails to claim the prize within fourteen (14) days after notification, BCBGMAXAZRIA will select an alternate winner in accordance with these rules. Likewise, if the original winner is ineligible or fails to timely return the signed Affidavit and Release(s), or in the event of non-compliance with any other requirements of this Sweepstakes, the winner shall forfeit the prize in its entirety, and BCBGMAXAZRIA will award the prize to the alternate winner.
12. The winner is responsible for any and all income, sales or excise taxes that may apply. BCBGMAXAZRIA shall not be liable for any such expense.
13. The winner will be required to sign and return to BCBGMAXAZRIA an Affidavit of Eligibility and a Prize and/or Publicity Release.
14. By entering this Sweepstakes, participants consent to the use of their name, likeness, image and biographical data for advertising and promotional purpose without additional compensation, except where prohibited by law. BECAUSE BCBGMAXAZRIA COLLECTS PERSONAL INFORMATION FROM PARTICIPANTS ENTERING THIS SWEEPSTAKES, BCBGMAXAZRIA ENCOURAGES ALL PARTICIPANTS TO REVIEW ITS PRIVACY POLICY located at http://www.bcbg.com/helpdesk/index.jsp?display=safety&subdisplay=privacy .
15. BCBGMAXAZRIA reserves the right to terminate this Sweepstakes or modify any rules as necessary for any reason or as required by applicable law. BCBGMAXAZRIA reserves the right, at its sole discretion, to disqualify any person it believes has intentionally violated these rules or tampered with any element of this Sweepstakes.
16. If by reason of a printing or other type of error more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.
17. All entry forms become the property of BCBGMAXAZRIA and will not be returned. Information on the entry forms may be shared with BCBGMAXAZRIA's partners, distributors, franchisees, subsidiaries, advertising and promotion agencies and affiliates. BCBGMAXAZRIA and its affiliates will not use entrants’ mobile phone numbers for telemarketing purposes.
18. This Agreement is governed by the laws of the State of California, without giving effect to conflicts of law rules.

By entering, each participant agrees that any and all disputes, claims and causes of action arising out of or connected with this sweepstakes, other than its administration, shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in the County of Los Angeles, CA. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and BCBGMAXAZRIA in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules.
