1. CONSUMER DISCLOSURES AND PRIZE: One (1) grand prize will be awarded to one (1) winner (the "Winner") consisting of two (2) tickets to attend the BCBGMAXAZRIA Spring 2011 runway show in New York, NY in September 2010. Prize includes two (2) round-trip airline tickets to New York City for the Winner and a guest, and a two-night (2) stay in one (1) hotel room in New York, NY, in September 2010. Prize also includes $500 worth of Stila product and a Stila makeover. All travelers must possess required travel documents, including a passport for international travel prior to departure. Winner and Winner's guest must be 18 years of age or older by February 1, 2010. All travel and accommodation will be booked by BCBGMAXAZRIA, and all such accommodations and travel shall be at BCBGMAXAZRIA's sole discretion. Other restrictions may apply. The Winner will be contacted to arrange travel dates. All costs not mentioned herein are the responsibility of the Winner (e.g., ground travel, meals, entertainment, spending money or any additional prize not specified herein). Certain restrictions may apply. The prize cannot be redeemed for cash and may not be substituted or transferred by the winner. The total approximate retail value of the grand prize is $1,500, but may vary depending on airfare in effect at the location and time of departure. Winner will be required to complete/sign/return an Affidavit of Eligibility and Liability Release and, except where prohibited, a Publicity Release within fourteen (14) days of receipt or prize will be forfeited and awarded to an alternate winner. The Sweepstakes is sponsored by BCBGMAXAZRIAGROUP, Inc., 2761 Fruitland Avenue, Vernon, CA 90058 ("Sponsor" or "BCBGMAXAZRIA").
The Winner and his or her travel companion must travel together on the same itinerary and possess all required travel documents, including visas and valid passports, if and as applicable. All aspects of the travel portions of the prize must be conducted on such dates as determined by BCBGMAXAZRIA in its sole discretion. The dates of departure and return are subject to change at BCBGMAXAZRIA's sole discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Travel must be booked at least two (2) weeks prior to travel and all travel must be completed prior to September 13, 2010. All airline tickets are subject to flight variation, work stoppages and schedule or route changes. BCBGMAXAZRIA reserves the right to structure travel route and select hotels in their sole discretion. The Winner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules. The round-trip air transportation element for the prize begins and ends at the point of departure. In the event the Winner and/or his or her travel companion engage in behavior that (as determined by BCBGMAXAZRIA in its sole discretion) is obnoxious or threatening, illegal or intended to annoy, abuse, threaten or harass any other person, BCBGMAXAZRIA reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send the Winner and/or his or her travel companion home with no further compensation. The prize is subject to seat and hotel availability, as well as BCBGMAXAZRIA's terms and conditions generally applicable thereto. If, in the judgment of BCBGMAXAZRIA, air travel is not required due to winner's proximity to prize location, ground transportation will be substituted for round-trip air travel at BCBGMAXAZRIA's sole discretion. The difference in value will not be awarded to the Winner.
BCBGMAXAZRIA shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. Additional prize award details and travel information to be provided to the Winner at the time of prize notification. BCBGMAXAZRIA reserves the right to substitute a prize of equal or greater value if the advertised prize is unavailable for any reason. The prizes are not transferable, assignable or redeemable for cash. No prize substitutions, except as provided herein. It is the responsibility of the Winner and guest to provide proper documentation. Winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that BCBGMAXAZRIA has not and will not obtain or provide travel insurance or any other form of insurance. Guest traveling with winner must be eighteen (18) years of age at time of prize fulfillment. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of BCBGMAXAZRIA. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by BCBGMAXAZRIA's airline carrier of choice as detailed in the passenger ticket contract. Lost, stolen or damaged airline tickets will not be replaced or exchanged. All expenses not specifically mentioned herein are not included as part of any prize package, and are solely the Winner's responsibility, including, but not limited to: hotel taxes, additional ground transportation at the Winner's destination(s), travel insurance, room service, bag check fees, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, tips, gratuities and service charges. Airline carrier and hotel regulations and conditions apply. Travel and lodging are subject to availability, and any changes made to either of these will be at the expense of the Winner. The Releasees (defined in Section 9 below) shall not be liable for any loss or damage to (a) any baggage or any unauthorized intervention whether or not caused by any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity(ies), equipment failure, including overloading of the Website due to excessive use, threatened terrorist act(s), terrorist act(s), air raid(s), blackout(s), act(s) of public enemy, earthquake(s), war(s) (declared or undeclared), fire(s), flood(s), epidemic(s), explosion(s), unusually severe weather, hurricane(s), embargo(s), labor dispute(s) or strike(s) (whether legal or illegal), vandalism, labor or material shortage(s), transportation interruption(s) of any kind, work slow-down(s), civil disturbance(s), insurrection(s), riot(s), abductions, or any other similar or dissimilar cause(s) beyond BCBGMAXAZRIA's sole and reasonable control; (b) damage caused by computer virus or otherwise resulting to any computers from any entrant's access to the Website or entry into the Sweepstakes; (c) printing or other errors appearing in the Official Rules or other Sweepstakes materials; or (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from any entrant's participation in the Sweepstakes or receipt or use of any prize. BCBGMAXAZRIA shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any performer(s)/event(s), air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. BCBGMAXAZRIA shall not be liable for any loss, theft or damage of cash, cameras, jewelry, securities, heirlooms, negotiable papers or other valuables. If the Winner becomes disabled or cannot otherwise fully enjoy the prize travel package due to illness, BCBGMAXAZRIA shall have the option of: (1) being relieved of liability for fulfillment of the prize award; or (2) at BCBGMAXAZRIA's sole discretion extending the period during which the prize may be awarded for a period equal to the duration of the Winner's disability or illness, in which case certain prize components may not be available. The Winner must prove such disability by a doctor's certificate, which certificate shall be endorsed by another physician agreeable to BCBGMAXAZRIA and Winner at BCBGMAXAZRIA's expense. BCBGMAXAZRIA's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision; you further agree that in any cause of action, BCBGMAXAZRIA's liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall BCBGMAXAZRIA be liable for attorneys' fees and/or experts' fees and costs.
Winner and Winner's guest are solely responsible for all applicable federal, state and local taxes and any other expenses and costs not expressly listed above. All taxes on prizes and other expenses related to accepting and/or using these prizes not listed in these Official Rules are the sole responsibility of the Winner. The value of the prize Winner receives will be taxable to such Winner as income. All Winners must supply BCBGMAXAZRIA with his/her social security number for tax purposes. An IRS Form 1099 will be issued in the name of Winner, for the actual value of the prize received. Failure to complete the trip does not relieve the Winner of his or her tax obligations associated with winning the prize. BCBGMAXAZRIA shall have no responsibility or obligation to any winner or potential winner who is unable or unavailable to accept or utilize any prize as described herein.
2. ELIGIBILITY: Open only to legal residents of the 48 contiguous United States, who are 18 years of age or older as of February 1, 2010. Submission of an entry form signifies acceptance of the terms and conditions set forth in the Official Rules. Employees of Sponsor and their immediate families or persons who reside in the same household are not eligible to enter this sweepstakes.
3. ENTRY: There are two ways to enter the Sweepstakes:
(1) Online: Go to bcbg.com and click on "Runway Sweepstakes" to be linked to the Official Entry Form. Complete all of the questions and provide your name, address, mobile or other phone number and email address (if you have one), and send your entry by clicking the "Submit" link on the page. All online entries must be submitted between February 8, 2010, and February 24, 2010, 11:59 P.M. PST. Receipt of an entry occurs when BCBGMAXAZRIA's servers record the entry information.
(2) By US Mail: Legibly print your name, address, email address (if you have one), birthdate (month/day/year) and phone number on a 3" x 5" card and mail to: BCBGMAXAZRIA Fall 2010 Runway Sweepstakes (Retail), ATTN: Marketing Department, 2761 Fruitland Avenue, Vernon, CA 90058. All US Mail entries must be postmarked by 12:30 P.M. PST on February 20, 2010, and received by February 30, 2010.
Sponsor is not responsible for lost, late, damaged, illegible, incomplete, misdirected or postage-due mail entries. Limit one entry per person and/or household, per day, regardless of the method of entry. Multiple entries received per day and entries received prior to or after the event will be disqualified. Void outside the 48 contiguous United States and where prohibited/restricted by law. Sponsor is not responsible for errors in the administration or fulfillment of this sweepstakes, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this promotion based upon such error at its sole discretion without liability. Entries that are generated by a script, macro or other automated means and/or otherwise are not in compliance with these rules will be disqualified. BCBGMAXAZRIA shall have the absolute right to determine if an entry form is in compliance with these official rules.
4. WINNERS: One (1) potential Winner will be randomly selected on or around July 15, 2010, from all eligible entries received by Sponsor. Drawing will be conducted by an independent representative of Sponsor whose decision is final and binding in all respects. Potential Winner will be notified via mail or telephone on or around July 15, 2010, with instructions for claiming the prize and will have thirty (30) days to claim the prize. The addresses on the invitation submitted are the only addresses used for the sweepstakes. No cash or other substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize with another prize of greater or equal value. Winner is solely responsible for any and all applicable fees and taxes associated with prize receipt and use. All decisions of the representative are final and binding.
In the event that the first entry form selected is discovered to be invalid for any reason whatsoever, or if the person who submitted the first entry form does not contact BCBGMAXAZRIA within the time frame specified above, another winner will be selected, subject to the same rules and conditions set forth herein.
5. GENERAL: Sponsors and their dealers, affiliates, advertising agencies, suppliers and vendors assume no responsibility or liability for damages, losses or injury resulting from acceptance or use of prizes. By acceptance of prize, winner consents to Sponsor's use of his/her name, city of residence, photograph and/or likeness for advertising and/or trade purposes without further compensation. By receipt of a prize, winner agrees to release and hold harmless Sponsor and its officers, directors, employees and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize. Any applicable taxes are the sole responsibility of winner. Subject to all federal, state and local laws and regulations. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules. Entries will become the property of Sponsors and will not be acknowledged or returned.
6. ODDS OF WINNING: The odds of winning depend upon the number of eligible entries received.
7. REPRESENTATIONS: By entering the Sweepstakes, each participant warrants that he or she has read and agrees to abide by all Sweepstakes Official Rules, and that he or she is not prohibited from participating in the Sweepstakes. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on the website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and, the discrepancy will be resolved in BCBGMAXAZRIA's sole discretion. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Each participant agrees to release, discharge, indemnify and hold harmless BCBGMAXAZRIA and its affiliates, partners, subsidiaries, distributors, franchisees, employees, officers, directors, agents, representatives and advertising and promotion agencies from any liability arising from or related to the Sweepstakes, including, without limitation, personal injury, death, property damage and claims based on publicity rights, defamation or invasion of privacy. Participants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or use or redemption of a prize.
8. PRIVACY POLICY: Because BCBGMAXAZRIA collects personal information from participants entering this sweepstakes, BCBGMAXAZRIA encourages all participants to review its Privacy Policy located at http://www.bcbg.com/helpdesk/index.jsp?display=safety&subdisplay=privacy.
9. SPONSOR RIGHTS: BCBGMAXAZRIA reserves the right to terminate this Sweepstakes or modify any rules as necessary for any reason or as required by applicable law. BCBGMAXAZRIA reserves the right, at its sole discretion, to disqualify any person it believes has intentionally violated these official rules or tampered with any element of this Sweepstakes.
10. SPONSOR OWNERSHIP: All entry forms become the property of BCBGMAXAZRIA and will not be returned. BCBGMAXAZRIA and its affiliates will not use entrants' mobile phone numbers for telemarketing purposes.
11. LEGAL DISPUTES: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Los Angeles, California. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this promotion), and participant further waives all rights to have damages multiplied or increased.
